2.1 Acceptance and Service Scope

By accessing, browsing, registering, purchasing, subscribing, uploading files, joining communities, or using Grow, the user accepts these Terms and Conditions, Privacy Policy, Cancellation and Refund Policy, Cookie and Analytics Policy, and Liability Disclaimer.

Grow covers online mock tests, question banks, custom tests, assignments, subject-wise practice, smart performance analysis, dashboards, subscriptions, free trials, and exam-preparation analytics. The user must not use the service if the user does not agree with these terms.

 

2.2 User Eligibility and Account Responsibility

Users must be legally competent to contract under Indian law. Users below 18 years may use the service only with verifiable consent and supervision of a parent or lawful guardian.

Each account is for individual use only unless Physiosimplified expressly authorises institutional or group access in writing. Users must not share credentials, sell access, permit multiple unauthorised persons to use one account, impersonate another person, or bypass access controls.

 

2.3 User Licence

Upon valid purchase, enrolment, subscription, or authorised access, Physiosimplified grants the user a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access Grow content solely for personal academic, educational, professional-development, or exam/research support purposes.

No ownership, copyright, trademark right, database right, source-file right, resale right, reproduction right, public performance right, redistribution right, or commercial exploitation right is transferred to the user.

 

2.4 Intellectual Property Ownership

All question banks, mock tests, custom tests, answer explanations, subject-wise tests, score reports, analytics dashboards, assignments, test interface, algorithmic scoring logic, and platform design are owned by or licensed to Physiosimplified Private Limited and are protected by copyright, trademark, contract, database, and other applicable intellectual property laws.

All rights not expressly granted to the user are reserved by Physiosimplified.

 

2.5 Strict Prohibited Uses

Users shall not directly or indirectly engage in the following conduct:

1. screen-record, audio-record, photograph, download, copy, reproduce, transcribe, scrape, crawl, extract, mirror, modify, translate, adapt, sell, resell, publish, upload, distribute, or commercially exploit protected Physiosimplified content;

2. share protected content through Telegram, WhatsApp, Google Drive, YouTube, Instagram, Facebook, X, LinkedIn, websites, apps, LMS platforms, file-sharing systems, private repositories, or institutional channels without written permission;

3. remove, crop, obscure, alter, bypass, or tamper with watermarks, timestamps, DRM indicators, digital tracking markers, copyright notices, user identifiers, or security controls;

4. use bots, crawlers, scrapers, automated scripts, browser extensions, emulators, recording tools, extraction tools, or AI systems to harvest platform content, dashboards, tools, questions, PDFs, or reports;

5. create derivative courses, cloned dashboards, copied notes, competing question banks, copied analytical templates, or repackaged educational products using Physiosimplified material;

6. use the service for unlawful activity, academic misconduct, data theft, patient confidentiality breach, harassment, spam, infringement, fraudulent chargebacks, or cyber abuse.

 

2.6 Remedies for Intellectual Property and Platform Abuse

Any breach of intellectual property, anti-piracy, account-sharing, scraping, unauthorised redistribution, data misuse, or platform-abuse obligations may result in immediate suspension or termination without refund, removal from communities, cancellation of access privileges, device/email/phone/payment identifier blocking, takedown notices, and civil or criminal legal action.

Because unauthorised distribution or extraction of digital content causes commercial loss that may be difficult to quantify, the user agrees that Physiosimplified may claim reasonable pre-estimated contractual compensation of at least Rs. 50,000 per incident or five times the applicable course, subscription, or service fee, whichever is higher, without prejudice to its right to claim higher actual damages, injunctions, account of profits, delivery up, legal costs, or any other remedy awarded by a competent court.

 

2.7 Grow-Specific Terms

Grow analytics and performance reports are educational feedback tools and not definitive predictors of actual examination performance.

Users must not copy, photograph, export, scrape, record, reconstruct, or share questions, explanations, score reports, test screens, or dashboard analytics.

Subscription cancellation prevents future renewal but does not by itself create a refund for the active billing period after access or consumption.

 

2.8 No Guarantee

Physiosimplified does not guarantee exam rank, examination success, admission, selection, score improvement, passing result, professional eligibility, or academic outcome. Any testimonials, examples, screenshots, scores, outcomes, or educational claims are illustrative and do not create a guaranteed result.

 

2.9 Limitation of Liability, Indemnity, and Jurisdiction

To the maximum extent permitted by law, Physiosimplified Private Limited, its directors, instructors, consultants, analysts, employees, affiliates, contributors, and community administrators shall not be liable for indirect, incidental, special, consequential, punitive, academic, professional, clinical, financial, reputational, or data-related losses arising from use of the service.

Nothing in these terms excludes liability that cannot legally be excluded, including proven gross negligence, wilful misconduct, statutory fraud, or non-waivable consumer rights.

These terms are governed by Indian law. Subject to mandatory consumer jurisdiction rights under applicable law, courts at Pune, Maharashtra, India shall have exclusive jurisdiction.
